HostingOxygen — Acceptable Use Policy (AUP) & Terms (Summary)

By using any HostingOxygen service, you agree to this Acceptable Use Policy (AUP) and to our Terms of Service (TOS) and Privacy Policy. This AUP applies to all users, including visitors who do not hold an account and paying subscribers. We support the free flow of information on the Internet and do not routinely monitor customer content. However, we may remove content, suspend service, or terminate accounts that are illegal, harmful, violate this AUP/TOS, or expose HostingOxygen to liability. We may cooperate with law-enforcement and third parties in investigations.

1) Our Goals

  • Ensure reliable service for all customers.
  • Protect the security and privacy of our network and of others.
  • Comply with applicable laws and industry best practices.
  • Encourage responsible Internet use and preserve free expression.

2) Security & Privacy

We store account information securely and share it only as needed to provide services, comply with law, prevent fraud/abuse, or with your consent (see Privacy Policy).

You are responsible for safeguarding credentials and all activity under your account, whether by you, employees, contractors, or guests.

3) Prohibited Content & Activities

The following are not allowed on HostingOxygen services (including hosting, VPS, RDP, and BDIX-connected services):

  • Illegal activities of any kind, or activities that assist/encourage illegal acts.
  • Child sexual abuse material (CSAM) or any underage/“Lolita” content. Zero tolerance: immediate termination and reporting.
  • Threats, harassment, hate, or incitement; material encouraging property destruction or bodily harm.
  • Fraud and deception: phishing, scams, pyramid/ponzi schemes, fake shops, impersonation.
  • IP infringement: hosting/linking pirated, “nulled,” cracked, or otherwise unauthorized content/software/media/keys.
  • Email abuse / SPAM: unsolicited bulk messages; address harvesting; forged headers; bulk-mailing for third parties; advertising via spam sent elsewhere.
  • Network abuse: DDoS, unauthorized port scanning, brute-force, malware/virus distribution, C2, open proxies/relays, or activities that degrade networks.
  • Unauthorized access attempts to any system, account, or data.
  • Collection of personal data without consent or in violation of law.
  • Resource abuse: excessive CPU/RAM/disk/IO/bandwidth that impacts others; file-distribution mirrors on plans not designed for it.
  • Free hosting or public file distribution hubs on shared/reseller plans (image/video/file portals, RapidLeech, torrent trackers/indexers).
  • Large-file distribution where primary purpose is download/redistribution on plans not intended for it (guideline: files > 50 MB on shared/reseller).
  • Chargeback/payment abuse.
  • BDIX-specific: no VPN/Proxy/Tunneling or hosting suspicious/obfuscated files/traffic on BDIX services.

4) Email & Anti-Spam (Zero Tolerance)

  • Send only to opt-in recipients and include a working unsubscribe.
  • No third-party proxies (SOCKS/HTTP, etc.) relaying mail to destination SMTP servers.
  • If your activity causes blocklisting of our IPs, service may be suspended until resolved.
Penalties: First violation may incur a $250 Administrative Fee; second violation $500 plus immediate termination. Research time may be billed up to $175/hour.

5) Resource Usage

You may not run workloads that materially degrade performance for others. We may throttle, restrict, bill for overages, or terminate services that exceed plan allocations or fair-use thresholds (e.g., CPU/IO-heavy scripts, abusive cron jobs, public file repos, unoptimized code).

6) Network & System Rules

  • IP Ownership: Assigned IPs remain HostingOxygen property and may be changed or reclaimed; justification must follow RIR policies; use name-based hosting where possible.
  • Bandwidth & Disk: Ingress and egress count toward monthly allocation; no rollover. Overages may incur fees, throttling, or suspension.
  • Security: Do not probe, scan, bypass authentication, or forge TCP/IP or email headers.

7) Payments, Billing & Refunds

7.1 General

  • Service is provisioned after payment. Renewals are due on the billing date.
  • Accounts 7 days past due may be suspended; reconnection/late fees may apply.
  • Chargebacks/disputes may lead to immediate suspension/termination. For disputed domain payments, we may modify registrant/admin data to secure the asset until resolved.

7.2 Refunds

  • Shared & Reseller hosting: 7-day money-back on first purchase when paid online (cards/PayPal). Bank transfers, money orders, domains, licenses, dedicated IPs, migrations, setup fees, and abuse/violation cases are non-refundable.
  • VPS/RDP/Dedicated/Custom: Non-refundable, except the BDIX policy below.

7.2.1 BDIX VPS & BDIX Windows RDP — 24-Hour Limited Refund

We provide a 24-hour limited refund window for new orders of BDIX VPS and BDIX Windows RDP.

Eligibility

  • Request submitted within 24 hours of provisioning (per our system timestamp).
  • Service was unusable due to our platform fault or unplanned/emergency maintenance (not scheduled/announced maintenance).
  • Ticket opened at support@HostingOxygen.com within the 24-hour window with details/logs.

Not Eligible

  • Any violation of this AUP/TOS or items under Prohibited Content & Activities.
  • Scheduled/announced maintenance, third-party network issues, customer misconfiguration, software bugs in your apps, high resource usage caused by your workload, or DDoS targeting your service.
  • Renewals, plan changes/upgrades, add-ons (IPs, licenses), reinstalls, migrations, or services previously refunded.

Process & Outcome

  • If eligible, we refund the first billing cycle’s service fee to the original payment method.
  • Setup fees, licenses, domains, and processor fees are not refundable.
  • Upon refund, the service is terminated immediately and data deleted.

8) Account Setup, Cancellations & Data

  • Provisioning: New domains typically propagate within 24 hours; some setups can take up to 7 business days. Transfers commonly take 7–60 days.
  • Cancellation: Only the verified account holder (or authorized contact) may cancel. Provide 7–60 days’ notice to support@HostingOxygen.com. Usage/overage charges through the cancellation date will be billed.
  • Backups: You are responsible for your own backups. Courtesy backups (if any) are not guaranteed.

9) Support Boundaries

24×7 support covers the availability and basic functionality of your hosting environment and network. We do not provide application-level development/support or downstream customer support unless specifically contracted.

10) Enforcement & Abuse Handling

  • First violation: Warning and/or temporary suspension at our discretion pending your written agreement to stop the offending activity.
  • Second violation or severe abuse: Immediate suspension or termination without further notice.
  • We may suspend any service we reasonably believe is the source or target of a violation. In severe cases we will notify law enforcement. Suspended time is not credited.

11) Domains & Large Files (Shared/Reseller)

HostingOxygen is not a general file-hosting or CDN service. Sites primarily for downloads or hosting large, unlinked files may be suspended or files removed. If we handle a domain transfer on your behalf, a handling fee may apply. If you cancel during transfer, all performed work is billable.

12) BDIX Services (Important)

BDIX-connected services are designed for low-latency access within Bangladesh. You may not use BDIX services to run VPNs, proxies, tunneling, or to host obfuscated/suspicious archives or traffic patterns. Abuse can lead to immediate termination.

13) Warranty, Liability & Force Majeure

Services are provided “as-is” and “as-available.” We disclaim all warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of data or profits. Our aggregate liability will not exceed the fees paid for the affected service period.

Neither party is liable for delays or failures due to events beyond its reasonable control (force majeure), including natural disasters, war, labor disputes, government actions, failures of suppliers, or Internet-wide outages.

14) Customer Responsibilities & Content

You are solely responsible for content hosted on or transmitted through your services. Do not remove or obscure copyright, trademark, or proprietary notices in licensed software. Do not reverse-engineer, decompile, or disassemble licensed software unless permitted by law.

15) Changes to this AUP/TOS

We may revise this AUP/TOS at any time. Updates take effect upon posting to our website. Continued use of the services constitutes acceptance of the changes.

16) Miscellaneous

  • Keep your account contact information current (email and phone).
  • Failure to enforce any provision does not waive our right to enforce it later.
  • You may not assign your agreement without our written consent; we may assign without notice.
  • We may refuse service to anyone at any time for any lawful reason.
  • Verbal abuse or threats toward staff can result in immediate termination without refund.
